1. Acceptance of these Terms

These Terms & Conditions ("Terms") govern the use of the website (berealbefit.com) and the mobile app of BE REAL BE FIT, S.A. DE C.V. (hereinafter, "Be Real Be Fit," "we," or "the Service"). By creating an account, subscribing, or using the Service in any way, you accept these Terms in full. If you disagree, you must not use the Service.

The processing of your personal data is governed by our Privacy Notice, which is incorporated into this agreement by reference.

If you use the app on an iPhone, Apple's Standard Licensed Application End User License Agreement (EULA) also applies; it governs the license to use the app downloaded from the App Store.

2. What the Service is

Be Real Be Fit is a training and nutrition platform made up of a website (where you register and can subscribe) and a mobile app (where you view your routines, log your workouts, and keep your nutrition diary, and which on iPhone also lets you subscribe). Depending on your plan, your account may have a coach and/or a nutritionist assigned to follow up on your progress within the platform.

The Service includes training routines, meal suggestions and plans, estimated calorie and macronutrient calculations, body measurement tracking, and licensed exercise audiovisual content.

3. Eligibility and your account

• The Service is intended for people over 18 years old.
• You must provide truthful information when registering and keep it up to date. You are responsible for the accuracy of your profile data (age, medical conditions, injuries) used by you, your coach, or your nutritionist to plan your training and diet.
• You are responsible for keeping your password confidential and for all activity that occurs on your account. Notify us immediately if you suspect unauthorized use.
• Each account is personal and non-transferable — you may not share it with others.

4. Subscription, pricing, and payments

• You can subscribe on the website or, on iPhone, within the app. Either way, it is billed on a recurring basis (monthly, quarterly, or annually, depending on the plan chosen) until you cancel it.
• On the website, the charge is processed by Stripe, an independent third party. We never see or store your full card details.
• Within the app, the subscription is sold and charged by Apple to your Apple ID, under the App Store terms. Payment is charged when you confirm the purchase, and the subscription renews automatically at the end of each period unless you cancel it at least 24 hours before it ends. The price is the one the App Store shows at the time of purchase.
• Prices may change. If your plan's price increases, we will notify you — or Apple will, if you subscribed in the app — with reasonable notice before the new price applies at your next renewal.
• Your account is the same on the website and in the app, no matter where you subscribed: if you already have an active subscription, you don't need another one.

5. Cancellation and refunds

You can cancel your subscription whenever you want. Upon cancellation, you keep access to the Service until the end of the period you already paid for; no partial refunds are issued for the remaining time in that period, unless applicable law provides otherwise.

If you subscribed within the app, it can only be canceled from your Apple ID settings (on iPhone: Settings → your name → Subscriptions) or with "Manage subscription" in the app's Profile. Refunds for those purchases are decided and processed by Apple under its policies, and are requested at reportaproblem.apple.com. We cannot cancel or refund App Store purchases.

6. Nature of the Service: this is not medical advice

• Be Real Be Fit provides general training and nutrition guidance, not medical services, diagnosis, or treatment of any health condition. Nothing in the Service replaces the advice of a physician, a licensed clinical nutritionist, or another healthcare professional.
• Consult your doctor before starting any training program or change in your diet, especially if you have a pre-existing medical condition, an injury, are pregnant, or take medication.
• The calorie and macronutrient goals the Service calculates are estimates based on standard formulas (Mifflin-St Jeor / Katch-McArdle) using the data you enter. They are not an individualized medical or nutritional prescription.
• If your account has a coach or nutritionist assigned, their guidance is delivered through the platform (routines, meal plans) and does not constitute medical consultation or clinical nutrition, unless that professional expressly tells you otherwise through another channel and within their own professional license.
• Stop any exercise immediately if you feel pain, dizziness, unusual shortness of breath, or any other warning sign, and seek medical attention.

7. Intellectual property

• The name "Be Real Be Fit," the logo, the platform's design, and its content (routines, plans, text) are the property of BE REAL BE FIT, S.A. DE C.V. or its licensors.
• Exercise videos and animations are licensed from a third-party provider for exclusive use within the Service. You may not download, record, redistribute, publish on another platform, or use commercially that audiovisual content outside the app.
• You retain ownership of the data you generate (your measurements, workout logs, food diary). You grant us a limited license to use it solely to provide you the Service and, in aggregate and anonymized form, to improve it.

8. Acceptable use

By using the Service you agree not to:

• Attempt to access other users' accounts or restricted areas of the system.
• Reverse engineer, scrape data in an automated way, or attempt to copy the Service's exercise, video, or food catalog.
• Use the Service for illegal or fraudulent purposes, or to harass others, including coaches and nutritionists.
• Impersonate another person or provide false information about your identity or health.

We may suspend or cancel your account if you violate these rules, without prejudice to any other action available under the law.

9. Account termination

You can delete your account whenever you want from the app, under Profile → Permanently delete my account. This permanently erases your account and your history and does not by itself cancel an active subscription: cancel it separately beforehand. If you subscribed on the website, you can also ask us to cancel it; if you subscribed in the app, it can only be canceled from your Apple ID (section 5), and Apple would keep charging it even if you delete your account.

We may suspend or cancel your access if you breach these Terms, if your payment is repeatedly declined, or as required by law.

10. Limitation of liability

• The Service is provided "as is" and "as available," with no guarantee of specific results (weight loss, muscle gain, or others). Results depend on individual factors outside our control.
• To the maximum extent permitted by law, BE REAL BE FIT, S.A. DE C.V. will not be liable for injury, harm to health, or indirect, incidental, or consequential damages arising from use of the Service, including following suggested routines or meal plans.
• Nothing in this section limits liability that cannot be limited under applicable Mexican law, including cases of willful misconduct or bad faith.

11. Changes to these Terms

We may update these Terms. We will publish any change on this same page with the updated date; if the change is substantial, we will notify you by email before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute related to the Service, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction that might correspond to them by reason of their present or future address.
